An Australian newsagent has filed a legal action against a local man, claiming that he falsely said that the man is due a share of an AU$63m lottery win.

A newsagent in Australia has taken a man to court for pretending to be owed AU$260,000 (US$186,375) in a lottery win. 250 people were a part of the ticket-buying syndicate that won AU $63m ( US$45m) through the Powerball lottery in February.

Kevin and Tania Parkes, the owners of City News Kalgoorlie, also purchased tickets with the syndicate. They lodged the writ of summons in the Western Australia Supreme Court against local man Mark Ing. The operator of the lottery, Lotterywest, is on the summons as the second defendant. A directions hearing will take place on August 2.

Parkes and Ing are suing Lotterywest over their $63m lottery win. They claim Ing was part of the unsuccessful "#1 Syndicate" and not the victorious " #2 Syndicate". Lotteries has not paid out the money yet.
