West Bengal and Uttar Pradesh support goods and services tax (GST) on online gaming, horse racing and casinos at a uniform rate of 28%. The group of ministers will take legal opinion on the matter before submitting the final report in a week to 10 days.
Bengal and Uttar Pradesh back 28% GST on full value for online gaming. The GST Council will consider the latest report, along with the earlier one submitted by the GoM in June. It will take legal opinion on whether the prize money in online games and horse racing is covered within the "actionable claim" before submitting the final report in a week to 10 days. The Supreme Court has already held in various cases that games of skill and games on chance cannot be separated. GST is levied on online skill-based gaming at 18% currently on the platform fee.
